Settlement Delayed, Settlement Denied Part 4: Delaying Tactic or Delaying Antic?

Supplemental Updates as of May 13, 2011

Dear Readers,

After the last batch of plaintiffs that filed opt-ins in January 2011, another cause of this already delayed settlement case, but this time, from the very lawyers of the Plaintiffs. I was surprised because the issue with them is not about attorneys' fees. As everyone knows, they gladly accepted their fees in the amount of $11,321,849.62 in total. But the issue this time is on material expenses and cost they incurred during the litigation of this case.

It is ironic because, it should be the least among complicated issues. It revolves around money, money and nothing but money. After all, money is the main driving force for their actions, c'mon let's face it.

In their meeting last February 28, the Court had asked plaintiffs' lawfirms Schneider Wallace, Grady Schneider, Goldstein, Demchak, Baller, Borgen & Dardarian, and Bailey Pinney  to submit documentation and receipts. However, since they only presented figures and numbers, the Court failed to grant their motion but instead RESERVED it until they can substantiate their expenses. Plaintiffs' lawyers asked the Court another extension of deadline until March 3.

But in March 3, these law firms with the exeption of Schneider Wallace, failed to submit their documentation and receipts supplementing their expenses and cost for the second time. Therefore, the Court was unable to complete its review of the expenditures.

At their subsequent meeting On April 1, the Court has only granted 3 Motions that Plaintiffs have requested but still RESERVED its ruling on Plaintiffs’ request for awards of costs incurred by Grady Schneider, Goldtsein Demchak, and Bailey Pinney pending Plaintiffs’ submission of supplemental documentation.

It is only on May 13, that the Court has finally approved Plaintiff's request for an award of litigation costs and expenses to Grady Schneider, Goldstein Demchak, and Bailey Pinney. Here's the breakdown:

  • Schneider Wallace:         $1,598.589.41 in costs and expenses
  • Grady Schneider:           $   217,323.64 in costs and expenses
  • Goldstein Demchak:       $     24,000 in costs and expenses
  • Bailey Pinney:                $    107,427.39 in costs and expenses

Here's the Court's exact words in its concluding statement in its May 13 decision:

"In sum, the Court GRANTS Plaintiffs’ request for an award of litigation costs and expenses as follows. The Court awards Grady Schneider $217,323.64 in costs and expenses. The Court awards Goldstein Demchak $24,000 in costs and expenses. The Court awards Bailey Pinney $107,427.39 for costs and expenses. Pursuant to the terms of the Settlement Agreement, the remaining $6,418.38 previously reserved from the Settlement Amount shall be included the Settlement Payment distributed to Authorized Claimants.


IT IS SO ORDERED."


Of course we respect the decision of the Court.

But, if you compute the days passed from February 28 until May 13, that's another solid 6 weeks of delay. Should plaintiffs' lawyers filed their expenses and costs together with receipts and documentation in their meeting last February 28, the court should have been more expeditious in granting these motions and we wouldn't have all these delays in the first place.

It seems to many that this is nothing but delaying tactic AND delaying antic on the part of the lawyers. They should be more expeditious to perform their work on time. After all, this is all about their reward. I said "their" reward because we all know that they get compensated first before plaintiffs do.   This has been causing pain in the rear for most of the class members. How much more time do we have to wait for our check to arrive in our mailbox? 

We dare anyone from the plaintiffs' lawyers to come up and answer these questions. They should give Plaintiffs some concrete dates and not just some fancy "any day of the year" predictions. If they couldn't send  email updates to every class member, (which is the easiest thing to do, BTW and the least expensive) at least they should update their website dedicated to this settlement case, right?  When was the last time they updated their webpages for this case? Two years ago?

It is not difficult to update a webpage. You and I can do it. They already have all the latest information about the case and they know better than the rest of us, right? If they can't do it, then I am willing to volunteer myself to update their webpages pro bono if that is necessary in the service of the more than 30,000 class members that participated this case.

When was the last time you get an email from Rust Consulting or from any of the law firms representing the Plaintiffs? I believe that it is their responsibility to inform their clients because it is also the right of every class member to be informed. We are not questioning their expertise or reputation but at least they should inform all eligible claimants what's happening. C'mon your honors, speed up the settlement, let us know what's going on, and do not be a cause of the delay...again.

    I am one of the named plaintiffs... They aren't even telling us what is going on let alone giving us any dates for the checks to be mailed. I have sent three emails now to the different lawyers representing the case and haven't heard a word back from them. I wish this posting would've had more info for us.. I want to know what is going on!

    Why aren't the expenses deemed cost of doing business? When I buy a burger I'm not charged on top of the cost of the meal for the spatula it took the guy to flip the burger with. It seems absorbent for them to allocate so much money on top of the fees for materials used to do their job.

    Wake up everyone! They will find more fees, costs etc., till virtually nothing is left but your $25 min. We will receive these checks 2-3 years down the road when we all have given up. That will probably be just enough to buy 3 gallons of obama gas.

    As of today, 5/26/2011, settlement checks are expected to be sent in June 2011 per Rust Consulting. I was told to contact them if payment was not received by June 30th.

    I was wondering how long they can take before they are required to start paying interest on the amount owed to us.... they are making interest off of this money, the longer it sits in an account, the more money they are making....

    What I make in interest on my bank account monthly is minimal but I can only imagine how much $27million would bring in. Keeping my fingers crossed for June.

    If the settlement money would have been deposited in CD at .5% interest rate for the first 6 months, that would have been around $67,500.00 that is being compounded in June.

    I called Rust Consulting and was told June I tried to ask when in June like the beginning the middle the end she could tell me but as per the settlement notice it does say 25 days so I figure 25 days from May 13 should be around June 7 Hopefully no longer

    Okay, this sounds good, but what about the process. In the beginning they said all we had to do is stay updated on our address and other contact info. Then they said in the update that we would have to fill out a form that is mailed to us, send it, and then after they have a processing system take over, it may take another month. RGIS is banking money during this process and the lawyers could give a damn because they can increase their costs. Will we end up with enough to pay ISP fees for the past few months????

    Ok so I finally heard back from the laywers... It was not a friendly email either.. I was told it was not there responsibility to update us. the email stated that It was my job to call in and ask what was going on. Apparently they are under the impression that Rust consulting and their own secretaries are giving out the info we need. Anyhow he stated that the delay between the march 25th date and may 13th when they supposedly sent them the money was because RGIS had 30 days to appeal if they chose to do so. At the end of those 30 days... ( more like 45 in reality but they apparently forgot to study math) the money was released. No reason was given for why if they have had the money since the 13th they are waiting till the second week of June to start shelling it out. But I was told that it was highly probably but not guaranteed to show up in June.

    First the Good News: the checks will be mailed in the next week or two according to Rust. You should get them no later than June 30, but probably earlier.

    Now the Bad News: Rust Consulting will take out 37% for taxes. Also, the check may be smaller then what they said in the original letter since they added more claiments, although Rust cannot say how much smaller. But when you file taxes next year, you should get some the 37% back unless you are in a high bracket (unlikely).

    Regarding the lawyers: sure they took a lot of the $, but without them, we would have gotten zilch. Nothing. Nada.

    This is BS. I think the judge should order that lawyer fees be deducted for wasting his time. I can't believe all these firms in march dared to demand a certain amount of money for lawyer fees but yet in march they did not bring the receipts to back it up. As a result they had to delay the settlement until May 13.

    Enough with the damn games, the court needs to order commencement of checks. I know many people are relying on this settlement check to pay their bills. I know I am one of them. This is unacceptable.

    When people start getting their checks, please post it here so others can report a delay if they don't get it. Also, please post if the amount of the check is what they said it would be in the letter RUST sent out a few months ago. Hopefully, it won't be long now. I've already spent that money and the bill collectors are pounding on the door!

    I talked to Rust consulting today... They said the taxes that will come out will be the payroll taxes on your back wages. And it depends on the state you live in. I doubt it will be that big of a deal.

    This is all pretty insane. Id love to have more money right now. Im a 13 year employee. Im a top gun and have been for 10 of those years. My wage is maxed out at 11.75 and I will not get a raise becuase I am maxed out. Seems like another good reason to sue the crap out of the company. Im still counting faster every inventory, but have not seen more money in 3 years now. Between that and these delayed checks, Im about to run far away from this jok of a company lol

    RGIS is proud to say that TOP GUNS are the creme of the crop which exemplify the very essence of what RGIS is all about. But in reality, it is the opposite.

    Increasing your speed more as a TG won't give you monetary benefit because that is the highest you could get in the ASET level. The only you can get is a greater chance for CTS (carpal tunnel syndrome) and other occupational health hazard.

    Unlike the lower levels, they still have the chance to increase their productivity levels and therefore get paid everytime their APH levels improved.

    So, instead of adding another level higher than TOP GUN, RGIS would normally increase the store APH instead. So, even when you wanted to improve your APH as a TopGun if RGIS keeps on increasing the store APH, you won't get anymore than what you are paid now no matter how much you would like to.

    When you are a TopGun you APH is a cul de sac.

    Just a thought.

    Let me tell you bout the secret of RGIS... have one of you guys ever thought you're TG bcuz how fast you were counting in the stores. Had you ever think for a second... the reason why your APH was so sky rocket bcuz your AM/TL/PC operator (target or any bigger stores) had been told to modified the times to make the APHs. Sometimes you weren't even on the clock for several hours, even us as AMs/PCs weren't on the clock either. I knew all these craps cuz I was one of the AMs that had been told by the big bosses to modify your guys/my own times. For those experts whom busted your asses out there, if you all had ever wondered why your rank still remainds the same then starts asking for your time-sheets. If you want to make big bucks, apply for AM position then you will know excactly what we (AMs) called it as "BLOOD MONEY". Now, speaking about Scams... you have it, Go RGIS!!! :) NOT!!!

    Speaking of timesheets, Team Leaders and higher positions can modify timesheets for a particular inventory to suit and accomplish their needs at will.

    For instance, if a particular store APH is 1225 and the actual APH is 1025, as a TL or inventory manager, I can alter the timesheets from anyone in my inventory crew. The changes will be insignificant to those auditors that I made adjustment with, but the effect will be sufficient enough to meet the deficient store APH.

    Just in case other hourly employees are not aware of such practice.

    Is it a good practice? NO.
    Is it illegal? YES.
    Does RGIS aware of it? Your DM and RM are aware of that.

    RE: the last poster. The amount depends on the number of shifts worked. Rust Consulting sent out a letter late last year that gives an estimated amount of your own check. Everyone should have got this letter. Maybe you got it, but didn't read it thoroughly--the check amount is buried inside. Amounts vary--some may get as little as $50, others several thousand depending on number of shifts worked.

    I just tried to call Rust Consulting. A message came on and said the wait to talk would be about 45 minutes!!! I couldn't wait that long. I guess everyone is calling asking "WHEN DO I GET MY MONEY???!!!!!!" Did anyone manage to get through to Rust today to find out the mailing date? Thanks.

    RGIS!!! OMG what wasn't done in the name of APH. As a TL for several years that was responsible for supervising and conducting inventories in some very hi profile accounts it was made clear to me that APH was supremely important. Everything that could be done to make APH was to be done, sending people home early, taking breaks late at the three hour mark if possible, "counting up" areas that were not going to be reviewed. APH was so important that I would get as many as six phone calls during an event to check on APH. I personally refused to alter Auditors time in and time out, but if another TL was in the store we would clock them out early and have them 908 the unpaid time in the store. I would in many cases 908 unpaid "in store" time. I have heard of instances where between 5 and 10 minutes were shaved off every Auditors time to make APH. People being taken off "Adder" roles and denied the "bump" in pay in order to make APH. So sad that there are so many people out there that are so willing to stick it to the people they are responsible for in order to make such an arbitrary number as APH. In reality the only thing that should be protected at all cost is the trust and respect of the employees the TL/AM/DM are responsible for.

    Rust Consulting invested the money with Bernie Madoff. All gone.

    (Just a joke--We get our money this month)

    RE/ the questions of the 37% tax taken out--Rust will send you a 1099 form about the tax withheld. When you file your tax next year, you should get most of the 37% back as a refund since most of us are in a lower tax bracket. Really low income people might get ALL the 37% back. It will be like getting a second (smaller) settlement check! If you spend the first batch, you'll have a second batch next year!

    saquatch is an idiot. he worked there for 15 yrs and still cant count and read. 6k is whats left after all da expenses 2 da lawyers so they going 2 add dat 6k 2 da settlement payment dats being distributed 2 all claimants. should be atleast 12-13 mill left 4 us.

    I agree with last poster. If "sasquatch" doesn't like working for RGIS, maybe he should find another job. RGIS at least provides work in a bad economy. Also, accuracy is important still. A slow but accurate count is much better than fast but inaccurate count. Perhaps the ASET system could be tweaked a bit to make it more fair to all auditors, but all in all, RGIS is OK. Not perfect, but no company is.

    the case was nationwide. There are a few states California included however where the employees involved will get more money. I'm not sure if it comes with the settlement money though.... I'm one of the named plaintiffs but my total that I should receive according to the letter in January did not include the fines RGIS has to pay for not paying me the total owed when I quit working for them. They will have to pay that money on top of the settlement according to the lawyers. But nobody has explained how that works. Of course the Lawyers left out telling us about Rust consulting or that taxes would be taken out. But according to Rust consulting that 37% someone else posted was BS. The person I talked to said the amounts taken out would vary based on the different state laws. It does bug me hoever that I was specifically told by the lawyers on more than one occasion that the named plaintiffs would be paid at the same time as the lawyers and Rust tells me that everyone gets paid at the same time so even though the court approved the payout for us April 1st. No check has come yet.
    Oh and the fact that the lawyers have all blocked their email addresses now that they have been paid really irks me royally.

    37% is not far off. Depends where you live. They will take 28% fed. tax + whatever your state tax rate is. Some states have no income tax and some are as much as 9% - that's where the 37% comes from. The state I reside in is 3% - for a total of 31%.

    What's outrageous is that NO RGIS auditor is in the 31% bracket. Probably the majority of auditors pay little or no income taxes and qualify for earned income credit. So, they get free use of our money until we file for a refund next year!

    When I first started working for RGIS it was a fair place to work, it was family owned.It only
    went bad when it was sold. They fired me unlawfully and I took them to the board and got all of the 99 weeks UI. Now I have been waiting for money I earned over 3 years ago. I agree we should be paid interest on this because they have had our money all this time. And what is this other thing about money they have to pay separately, apart from the settlement?

    so hearing from an am is also nice especially about the time sheets because as a team leader i have been told many times to shave my one time to make things look better for the company? it has gone from being a fun work atmosphere to one where you have to be cut throat to make any money. the sad part is how even some of the managers have fallen in to line with shaving times when they at first were the ones against all the change. the whole change of how you are paid is a crock. when i have asked for a copy of the time sheet the usual saying is "no" then when i am running my stores i am told i am not allowed to save time sheets well little do they know i have a copy of every event that i have run and i will continue to do the same thing every time. so to all the team leaders who want to make the company look good just remember that the company really does not care about you or your family they just want the old dollar. and by the way start keeping track of these so called travel vehicles they clock us in on and out of events because it is not always happening with the vehicles that you may leave with??

    Oh my goodness, this is the biggest mess I have ever sen in my life. But it dont surprise me in the least. LOL RGIS also has this award they give you after either 20 or 25 years of service..     The only reason I got involved, and I am one of the first named class representatives, was because I think it is completely wrong how RGIS treats and continues to treat their hard working employees. I've told them countless times that I don't care about the stupid money. How much do you ACTUALLY think we're going to get, folks? Regardless of what it is, it will be so miniscule that it won't cover any kind of lost wages for any of us, so why are you wasting your time being angry? Perhaps RGIS will comply with labor laws now and people can be a little happier counting inventory.

    and FRUSTRATED, I couldnt have said it better. I am on the east coast and we have just recently started clocking in when we enter the inventory. It appears they are trying to comply after countless years of not doing so. But its still not right and chances are there will all ways be issues at this company. Especially with the ranking system. Its a good system but they use it to their own advantages mostly. Its just one of those companies you have to work for when you can do no better. Now tell me what can you expect from a company that hires practically anyone. Think about it. I mean practically ANYONE. Basically your past criminal history means nothing. Oh yea come aboard, we just need bodies to make our goal. Yea gimme that big juicy bonus check. LOL

    One bit of (possibly) useful information: I called Rust and they said the checks will probably be mailed out on a Friday--Friday the 17th or Friday the 24th. So, if they were mailed last Friday (the 17th) we should get them next week. If next Friday (the 24th) is the mailing date, the following week. So, getting close. No more than two weeks. I NEED THAT MONEY WORSE THAN I'VE EVER NEEDED MONEY!

    I worked for them for 1 year and busted my butt because we had 2 mortgages. There was no overtime pay, plus we had to be at the store 15 minutes before we started but didnt get paid. Don't dare work slow as your hourly pay will decrease.

    Hm! I do not understand any of this, anyone can file an order to show cause. Phone calls e-mails get up off your duffs, get waivers for your broke butts for court costs/filing fees, head to facilitators office they are paid to help you, and find out. *Do not forget to add your own fee and or punitive damages for hardship and pure mental anguish.
    There is also State Bar Association start filing complaints unethical conduct, failure to carryout fiduciary responsibility, put them in the hot seat. Do you really think the judge is going to not put his foot down if his court get's inundated with tedious backlog, because they aren't doing their job, which is by the way snubbing his order, making him look like a joke.
