Official Court Notice of Settlement of RGIS Class Action Lawsuit

Few days ago, Rust Consulting, Inc. the Claims Administrator for RGIS Settlement Lawsuit has mailed out tens of thousands of Official Court Notices to all members of the class (the Plaintiff) for the Case No.3:06-cv-05778 JCS and Case No. 3:07-cv-00032 JCS respectively.

The official notice said, among others, that the settlement provides a cash payment to hourly paid employees of RGIS who meet the class definitions as explained therein. Please review your mails recently because you may have overlooked it just in case. The Court Notice should looked similar to the one below:

7 important things you should know about the Court's notice 
Readers are encouraged to refer to the Official Settlement Notice for details. For those of you who have not receive the notice yet, you may request or call Plaintiff's lawyers representing the case for the said information. For those of you who have opted out from the settlement OR have missed to participate with the class action, the following updates are the important ones:

#1: How do I know if I am a part of the settlement?
If you have previously submitted a written consent form to join the collective action AND did not request to be exluced thereafter in either, Wren, et al v. RGIS, or Piper, et al v. RGIS and have been employed by RGIS as an auditor, ATL (Assistant Team Leader), Team Leader, AAM (Associate Area Manager) in the following States and dates listed below, then you are a part of the settlement.
  • In California between January 1 2005 and September 16, 2010
  • In Illinois between January 4, 2004 and September 16, 2010
  • In Oregon between September 20, 2000 and September 16, 2010
  • In Washington between September 20, 2003 and September 16, 2010
Note: A receipt of the Official Notice DOES not guarantee your inclusion of the settlement.

#2: How much can I get from the settlement?
The amount payment will vary. But your estimated payment can be found at Section 8 from the Official Notice you just received. Please proceed to Section 8: "What can I get from the Settlement." The Court assures that no class member will receive less than $25.00. Please review the estimated amount. Understand that the amount is only an estimate, meaning it is not final nor executory. 

For now, the lawyers can only provide estimates until all objections have been settled, if there are any. The more objections the Court will receive, the longer it takes to settle the case and the more your share will be delayed.  

#3: How can I get a payment?
Honestly, you do not have to do anything. I thought that was cool. However, for as long as you have maintained your status of being a class member AND provided a verifiable official address for the Claims Administrator to send you check, then you will receive a settlement check. Should you plan to move or change your address in the next 6 months, please contact the claims administrator at:

#4: When would I get my payment?
You will receive a settlement check approximately 25 days AFTER the effective date of the settlement. The effective date of settlement depends entirely on the outcome of the final hearing on January 28, 2011. But if there will be no objections or issues being raised, then you will get a settlement check most likely in the following month.

#5: Can I exclude myself from the settlement?
If you do not want a payment from this settlement OR you want to keep the right to sue or to continue to sue RGIS, then YES you may exclude yourself. This is called "opting out" of the settlement class. If you wish to exclude yourself, write a formal request and must be postmarked no later thatn December 15, 2010 and sent to:

Important: You MUST write a formal request since phone calls and emails shall not be accepted as forms of requests. Once you have excluded yourself, you CANNOT get any money from the settlement anymore.

#6: Can I sue RGIS for the same thing later?
NO. Unless you exlude yourself, you give up any right to sue RGIS for the claims of the same settlement. If you have a pending and different case against the defendant, speak to your lawyer who handles your case now.

#7: How the settlement will be divided?
Pursuant to the Settlement Agreement, class counsel may receive fees and costs from the gross settlement. Class representatives may also receive fees for their services. The following is an estimate:

Gross Settlement Amount:                           $27,000,000

Proposed legal service agreement:                $13,580,000
Class Representatives Service Fees:             $     120,000
Less withholding tax:                                    $
Less Administrative expenses:                      $

Estimated Legal Expenses:                          $14,000,000 ?
Estimated Net Settlement Amount:              $13,000,000 ?

The Estimated Net Settlement Amount will be subdivided among class members. Finally, it is the court that determines the reasonable rates for the service of class counsel and class representatives in this case. So these numbers will change.

  2. I was a auditor from Michigan. We drove 3 hours to a site and worked 7 hours without a break. I finally asked the AAM when the auditors would get a break. His response was...'when you drive home'. My response was...'someday RGIS will pay for your arrogance and when your fired for being HITLER...think of me.
    I think his name was JEFF WEST....if it is.....in my most polite and civil way.....F.O. YOU HITLER P.O.S. AND I HOPE YOU ARE HAVING A LOUSY LIFE!

  4. I was under the impression this was a national lawsuit, not just for 4 states. What about everyone else? RGIS being an ass isn't confined to the west.

    Should one assume this will be the end of it? Will no other lawyers pick this up?

  6. I last worked for RGIS about 2 years ago in Oklahoma City. I have received all the pertinent documents and info as explained in this blog and I do believe I'm due every penny, even if it is a minimum $25. I did this as a part-time gig and that's all I could stand. Some of the people I worked with were really cool, but some really lazy and sloppy. However, most of the managers/team leads were good. As far as the lawsuit, as long as you updated your info with the law firm/consulting firm, you're good. They emailed me every 3-6 months just to make sure they had current street address, email and phone number which was great because they don't want you missing out on anything.

  7. I have been working with RGIS since 2006 in da state of California. However we continue to get ripped off of our hours. We always have to stop at our district office for a team leader to pick up his upcoming store packets. We waist so much time there that we are not compensated for. I like working with that company only wish we would get what is rightfully ours. Then our company plays so much favoritism with people. They expect people to have a certain average but yet they put u in da worst areas that people constantly skip n add insult to injury they refuse to provide u with a finger laser. .

      Itz 2016,and they're still screwing lol out of they're hours.that they had worked for this acts like there slaves thy had fired my daughter because she had a baby n short my son in-law paycheck caused didn't give him,the right hours he worked for.....plus my olman was treated ignorant there ...no lunch,no food,no drinks,half time no breaks......screw them lol they don't pay them enough for traveling or working .....hell they just put in a straight 36hours nbut they don't appreciate it...they SSH oil dBbetreatinggood hardworking gppl with love respect n have some dignity of humanity to for these people......they haven't learned at all .....guess they have enough money need for another lawsuit.......since they didn't learn the first time

  8. District 74 management Tonya kauffman is dealing with personal life issues which she brings to the work place. She really is the wrong person they found since Marco left. She wont people to put inventory before family. She also needs to stop having relations with employees, really not a good look since she think nobody knows. lol.

One day youll be in a inventory and the next youll be leaving because someone anonymous told some bullshit on you. Really stupid shit, personally the job itself is to much for her to handle.     I would like to know ho0w many people were offered a $50.00 bonus for getting somebody to work for RGIS and never got it. Did it go in the AM's pocket. I tryed for a year and she had one excuse after another. Hum can I sue for that. It was just anothe way we were all used and abused.

  12. The $50 referral bonus is a rip off. Its all promises and nothing serious about it. My niece whom I encouraged to join my district has been around for 2 years now. I was told by my DM that I would get $50 for referral. My DM just tells me to wait on Christmas for my referral bonus, it's been 4 christmasses, but nevet get bonus.

    AFTER OUR OWN LAWYERS, DELAYED IT FOR 3 MONTHS, FINAL APPROVAL AND MOTION APPROVED FRO ATTY FEE'S AND DISBURTION OF CLAIM AS OF APRIL 1, 2011 ALL THE LAWYERS GOT PAID, ALL THE ORIGIAL CLASS MEMBERS, SO UNLESS THEY WANT A BIRCH IN AGREEMENT, THEY ONLY HAVE 25 DAYS AFTER RECEIVING THERE OWN PAYMENTS SO THE 2ND WEEK IS THAT DEADLINE, WHY THEY NOW SAY THE BEGAIN OF JUNE IS SO WRONG SO KEEP BUGING SCHUNDER AND WALACE THEY HAVE OUR MONEY AND ITS BEEN APPROVED TO DISTRUBUTE, WHY THEY HAVENT GIVEN THE UPDATE AND GO AHEAD TO RUST IS SHADY, SO IF WE DONT GET A CHECK OR CLAIM BY THE 2ND WEEK OF MAY, EVERY CLASS MEMBER FROM CALIFORNIA AND ORGON, WASHINGTON NEED TO START CONTACTING THE DISTRICT COURT OF APPEALS JUDGE SHARPO, AND DEMAND OUR SETTLMENT BE EXPLAINED WHY THEY HAVENT COMPLYED WITH RGIS SETTLEMENT 27 MILLION AND WHY THEY HAVEVENT PAID OUT THE ITS OPT IN CLASS MEMBERS ACCORDING TO LAW AND AREEGMENT TO SETTLE.     RGIS is a joke.. i worked for the concord distrct since 1999 .. and they worked me to death.. then i was let go for have another teamleader in my room after 12am..i traveled with the home depot team..i spent more time on the road then i did at home.. i aslo passed a hair drug test..and was one of the four that even passed out of 27 people ... and after all that they let me go for havimg somone in my room after 12am..

    How bad is rgis?Showed up for a 4 am store,no one there.Apparently it had been changed to 5 am.Why wasn' I told? team leader running store didnt have my phone number.WHAT-she didnt have the office number either? another store,scheduled for b/r,done in 90 minutes.told to clock out and come back in 30 minutes.clocked back in,told to go home 30 minutes later.no wonder they cant keep people.what a joke they are.

    Eveyone needs to be annoying to both the Lawyers
    at 1-800-689-0024 and the Claims Administrator at
    1-800-310-2748 all they keep doing is lying about
    when the checks are being sent out. They said last week that they already started sending them out and now this week they are saying not until the middle of July or even the end maybe. As of Friday, 6/17, the lawyers office stated the checks are in the mail {how old is this} and you should begin recieving them within a week. On Monday, 6/20 a call to the same atty. and the same receptionist, I was told the checks would sent out by 7/30 I immediatly call the claims administrator (877-310-2748). The response from them was the same I got 2 weeks ago from them "the money has been approved to distribute as of June 1, 2011 and and you should recieve it no later than June 30th. Again I called back atty. Schneider Wallace (415-421-7100) their response this time was checks will be mailed out by July 22, 2011. The reason being the attys. are going over thr list of people for proper payment (how long have they had this list, a couple of years). I asked, why is it taking so long the settlement was finialized on Apirl 28th? Response was they had to give time to appeal or opted out. I do believe that time period began after the January 28, 2011 hearing. Why are we going thru this again? Finally the receptionist got frustrated and said I can talk to Chris Springer, who is handling this and is taking calls. But he is not in today but you can leave a message and he will return your call (sure, who didn't know this). I left a message and no as of today, June 20th. - no response and I don't expect one. But tomorrow
    I will be calling back the attys. and the claim admin. demanding some straight answers and trying to get OUR MONEY IN OUR POCKETS sooner. We all need to call both numbers raise some hell, not just accept the dates coming from their pretty little voices. You ask, AM I FRUSTRATED - HELL YES, AM I MAD - HELL YES!!! 65,000 people are out there waiting - MAKE SOME CALLS - and then let us know.

  20. When i called i was told that they had a lot of people to pay and they were trying to figure out how much money everyone was supposed to get. That we would have our money by the end of June. Today is June 26th and I don't have a check yet. We are never going to see our money. They are keeping it to mnake money off of the interest. We need to call the California Bar Associatin and complain.

    I called Rust today and they say their still trying to do the fuguring of how much everyone is suppose to be getting. Then I called the Lawyers office and they said some checks have already been sent out, if you don't receive one by July 22 then to call them. They are all so inconsistent. They all need to get their SHIT together and tell the truth. Maybe if we can talk to the actual Lawyers and not there pions we might get some honest answers.

    I called Rust and they said checks were being mailed out at the end of the month. Has anyone seen a change in the way RGIS treats you now? Some changes in my district but not much. A few weeks ago they forgot to pay me for a 12 hour store and had to wait 2 weeks to finally get paid for it, A few stores after that I had a 12 1/2 hour store with a 10 minute break and a lunch then I was told to go to my next scheduled store which started a half hour after the first one was done. Anyone else being treated like that.

  24. I just got my check a couple of days ago. The way that RGIS operates depends on the state laws! I worked for this company in Montana for quite a long time. It's a tough job. I liked the travelling okay. I worked for them again in Portland oregon under the Vancouver district. What a complete change! My god, they treated me horrible and the way that they ran their stores was just too stressful to handle. I told them that that's not how we did it in my old district and they would get MAD! My settlement check is small, but that's okay because I really didn't work very much. I never worked a job longer that 4 hours in Vancouver. Just a waste of my time. Sounds from this blog that maybe another lawsuit is in order? Vancouver RGIS, you suck butts big time bud!

  25. When I first received notice of this lawsuit I thought to myself "yeah, riiight" and cast it off believing the Big C would EFF the system via $$$ because they seemed to get away with treating their employees like slaves.

    Worked for RGIS and knew I was getting ripped off - at first I was doing a superior job until one day, when suddenly all my counts were off, my method of counting was wrong, I had to be "supervised" in my counting, blah dee blah ok well I put up with it.

    2 weeks later myself and fellow employees received letters stating that our pay would be cut if we failed to perform to a standard.

    Now, I'm an "old school" type of employee. Despite my responsible nature, shortly after that letter I wasn't scheduled for work anymore - my manager explained through is brand new set of false teeth that I was "probably too smart for my own good." Whatever. I did figure out how their method of Planned Obsolescence where their employees were concerned, mixed with the threatened cut in pay, would merely further serve to line their own pockets.

    Yes, I received a settlement check - no, I still didn't believe it which is why I visited this site - to check the truth of it.
